Welcome to the Mi’kmaw Kina’matnewey learning platform. By accessing or using our services, you agree to be bound by these terms. Our goal is to foster a safe, collaborative, and educational environment for all members.
1. Acceptance of Terms
By creating an account, you agree to these Terms of Service and our Privacy Policy. If you are using this platform on behalf of a group or organization, you affirm that you have the authority to bind them to these terms.
2. Eligibility and Conduct
To maintain a productive learning environment, all users must be at least 13 years of age and, if under the age of majority in Nova Scotia (19 years of age), must have the consent of a parent or guardian, and agree to :
- Provide Accurate Info: Use your real identity or a consistent professional alias as required by your specific program.
- Maintain Security: You are responsible for any activity that occurs under your account. Keep your password confidential and do not share it with any third party. You must notify us immediately if you become aware of any unauthorized use of or access to your account.
- Respect the Community: No harassment, hate speech, or “trolling.” We operate on a basis of mutual respect.
- No Commercial Solicitation: This is a non-profit space. Do not use the platform to sell products or services without explicit written permission.
3. Intellectual Property & Content
- Organization Content: All course materials, videos, and branding provided by Mi’kmaw Kina’matnewey are our property or the property of our licensors. They are for your personal, non-commercial use only.
- User-Generated Content: You retain ownership of any original content you post (forum posts, assignments). However, by posting, you grant us a non-exclusive, royalty-free, non-sublicensable license to use, display, reproduce, and distribute that content solely within the LMS for educational and platform-operation purposes. We will not modify or create derivative works from your content without your consent.
- Copyright Compliance: Do not upload material that violates someone else’s copyright.
4. Fees and Donations
- Access: While many of our resources are free, some specialized courses may require a registration fee or a suggested donation to cover administrative costs. Any registration fees paid are non-refundable unless otherwise required by applicable law, or unless a course is cancelled by Mi’kmaw Matnewey prior to commencement.
5. Privacy and Data
We value your privacy. We collect data to improve your learning experience and track progress, in accordance with applicable Canadian privacy legislation. We will never sell your personal data to parties. We may share your information with trusted service providers who assist us in operating the platform, strictly under confidentiality obligations, and as otherwise required by law. 6. Termination of Access
We reserve the right to suspend or terminate your account if:
- You violate these terms.
- Your behavior disrupts the learning experience of others.
- The platform or specific program is discontinued.
7. Limitation of Liability
The LMS is provided “as is” without warranty of any kind. Mi’kmaw Kina’matnewey does not guarantee that the service will be uninterrupted or error-free. To the extent permitted by applicable law, Mi’kmaw Matnewey shall not be liable for any direct, indirect, incidental, special, or consequential damages, including loss of data, loss of revenue, or loss of opportunity, arising out of or in connection with your use of or inability to use the platform, regardless of the cause.
8. Changes to Terms
We may update these terms from time to time to reflect changes in our community or the law. We will notify you of significant changes via the email associated with your account.
